Just for your information how this is done here in the EU:
That is not perfect, but it kind of does work. That way police can keep those DIY electric motorcycles from our street, but everybody can ride eBikes.
You still have delivery guys and kids zooming on full assist bikes and scooters going +40kmh on sidewalks. I'm not sure how many of them are legal.
Most of them are not. But the police are not very active in that regard, at least here i Denmark. We have the 25km/h and 250w max pedal assist which I think is a good limit to distinguished them from mopeds and motorcycles.
It is trivial to hack the speed limiters. On some models, just a button long press.
