Faux News was sued for defamation, their defense was "First amendment rights" and were deemed to be entertainment more than news.
Here's a fun article from popehat.com about it.
Yep, they've even admitted to it, and used it to defend themselves in more than one defamation case. Since they acknowledge that they aren't an authentic news outlet, they should be forced to remove it from their name.
