The original game is a free download from the official site

IDK maybe it's only available for US
It is free on GOG too: https://www.gog.com/en/game/the_elder_scrolls_arena
Daggerfall is also free on GOG, which also has a FOSS recreation.
Im surprised they would bother.
they know they cant really sell it but if they make it available from their sources then they can keep the ownership clear. Its not like there is a lot of intererst in computer games from the early mid 90s
