I appreciate this kinda armchair lawyering. I aspire to speak this confidently about things I have an approximate knowledge of.
Ya this is on par with saying I wasn't shoplifting I was going to take it home to make sure it works then return it to the store because I am such a good samaritan.
Why do you folks think that joyriding and grand theft auto are different statutes? Mens rea in theft is very important and it has to have an intent to deprive. A jury wouldn't believe your example, but this dude actually DID bring them to the sheriff. You could argue civil tresspass to chattels or some local level minor property charge for unauthorized use if they didn't think they were depriving someone of their property. But it's not theft.
