You think small communities in Texas, Alabama, Mississippi, etc should be in charge of legislating trans rights, lol?
I think that it's more so that athletics associations like the NCAA or whatever their state-wide high school athletics associations that would be legislating it. And school boards. Granted it's not great and throws trans kids from conservative communities under the bus too because those school boards can be crazy. It's better than prohibition from the state level of government though
That was what he said. No I don't think it should be legislated, just fair which is what I was referring to.
Laws don't magically make anything fair. In fact they most often do the opposite.
My point is, it's not legislation or lack thereof that arbitrates fairness. There can be fairness outside of the law, and there can be fairness under the law. The law is not a sacred thing, it's just the opinion of a few privileged assholes. And it happens to be their opinion that they ought to be allowed to lock you up or kill you if you decide to disregard their opinions.
Why does it need to be law?
The whole point is it shouldn't be regulated by a cm government, but by the individual sports association.
How does government make if fair?
