Isn't the point of the right to try stuff, to try and prove that there is a medical use?
If the FDA comes back and says there is no known medical use, how else do you get data to show there is other than start experiments on terminally I'll people willing to try it through this program?
From the DEA's perspective, that catch-22 is entirely intentional.
