“Mass detention of marginalized individuals without due process harkens back to some of the darkest moments in our country’s history,” 4th Circuit Court of Appeals Judge Nicole Berner, a Biden appointee, wrote in a 2-1 majority opinion joined by Judge Barbara Keenan, an Obama appointee.

“Those shameful and abhorrent past detentions were limited in scope in comparison to the mandatory detention that the Government urges us today to find that Congress established thirty years ago in an ambiguously worded statutory provision. We decline to do so,” Berner wrote.

It’s the ninth loss in a row for ICE at federal appeals courts, all of which have now ruled on the policy. The Supreme Court is all but certain to take up the issue in its next term.

One Trump voter issued a tear-filled video regretting his decision to vote for the president after his brother, who served with U.S. special forces, died while in Immigration and Customs Enforcement.

In a video posted to social media, Naseer Paktyawal tearfully recalled his brother's service to the country and the moment that ICE "kidnapped" him in front of his son, Imrin. ABC News initially posted the video.

"I saw two cars unmarked. Seven, eight people jump out of those cars," Paktyawal said. "One on the driver's side, one on the back of his car, and grabbed him from his seat and put a handcuff on him."

Mohammad Nazeer Paktyawal's son, Imrin, was also featured in the video and recalled witnessing his father's arrest. "I was standing there, and then they came and just take him," the boy said.

Imrin added that he was "standing there" as the agents hauled his father away. "I was like, just don't take him, please," Imrin recalled.

According to Paktyawal, he later received a call from an ICE facility. "I thought they were going to release him back," Imrin said.

"He said, 'Are you, Naseer?' That's me," Paktyawal said. "Your brother Mohamed Nasir Paktyawal passed away this morning and his body is laying down in a parking lot in the hospital."

"My first vote was for this president, and I regret it, and I'm gonna regret it for the rest of my life," he added. "Because of me, because of my voting, He got arrested, and he lost his life. And I'm never going to forgive myself for that."

CNN reported that he was taken by ICE agents outside of his Dallas apartment and died less than a day after being in ICE custody. His family said that Mohammad had no known health conditions and had been seeking asylum in the U.S. since his arrival in 2021.
