I found the wording to be confusing, but if it helps anyone else, I think the situation is

before, they used to be able to get source code from Google with Git tags
now you need to get it through google drive, after requesting it through google forms
this is a ridiculous process, and over time they've gotten slower and slower at processing it, which is in violation of GPLv2

Git tags are just markers. If tags are the only thing that moved you can still access the repo, right? Just no version tags.

Looks like users on that thread are calling bullshit on Graphene for claiming GPL violations.

I'm not sure why they don't just sue Google if they feel so strongly they're in the right. Crowd fund the legal cost if they need to there will be plenty of their users willing to give them some money to stick it to Google. Use their Motorola money if they want. They expect a win and agreement in court so it's a no brainer.
