This would actually not meet the criteria of free and open source software if it were real.
TBF the Linux kernel already doesn't meet the criteria because of all the blobs (depending on who you ask, anyway). But yeah, shenanigans like this is why e.g. the Ubuntu font family is considered unfree despite its stated intention of being free.
