VP has no such power, what they were trying to do in 2021 was to make Pence do it and hope it would be unchallenged. And if someone challenged it hoping that conservative court would side with Republicans like they did in 2001.
VP doesn't have that power. Republicans were hoping Pence would do it anyway and then battle would go to courts and conservative SCROTUS would agree.
Until 2021 that date had no special meaning and it was just mostly ceremonial.
