No person shall be elected to the office of the President more than twice

Those are the exact words of the 22nd amendment. It's explicit. There's no ambiguity or room for other interpretations. Trump was elected twice, he's hit his limit, that's it.

[-] Bristlecone@lemmy.world 5 points 1 day ago

Conservatives don't give a shit about "laws" or the constitution

[-] Colonel_Panic_@eviltoast.org 9 points 1 day ago

Sure, but we didn't enforce the 14th amendment section 3, which clearly states that he shouldn't be president currently.

No one enforced our laws, so we have NO LAWS.

Which means, he can just run for president again and if no one enforced the law then it could happen again.

I agree with you on the law, but NO ONE IS ENFORCING ANY LAWS LATELY!!!! So what the fuck does any of it even matter anymore? Hmm?

[-] Cheebus@lemmy.world 1 points 1 day ago

This November is gunna be fucking fire one way or another

[-] MolochHorridus@piefed.social 15 points 1 day ago

I think the keyword here is “elected.”

[-] Natanael@infosec.pub 2 points 1 day ago

14A3. He's simply disqualified

[-] FrChazzz@lemmus.org 40 points 2 days ago

Unless those rumors are true and they did manage to game enough voting machines to clinch the election. In which case he was not actually elected twice…

[-] frongt@lemmy.zip 63 points 2 days ago

...and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.

[-] leadore@lemmy.world 14 points 2 days ago

And that's why Vance and the other fascists are waiting until after the midterms to get rid of trump.

[-] CharlesDarwin@lemmy.world 1 points 1 day ago

Vance is such a thoroughly unpleasant asshole. Of course, I thought the same thing about donnie for years.

But I don't think "JD" "Vance" has this weird hold on the idiots like donnie does. I guess we'll see.

Shrug. Somehow, Ted Cruz manages to get elected and it doesn't seem that anyone really likes him.

I suppose if the Democrats run a woman and/or someone non-xtian or non-white, there will be people that find a way to support "JD", I guess.

[-] Zahille7@lemmy.world 41 points 2 days ago

There better be a real fucking riots in the streets across the entire damn nation if they come out with this bullshit.

Like I mean burning down federal buildings and police stations, storming the homegrown concentration camps to free the prisoners, a literal million+ person march on Washington DC right to the front door of the White House.

[-] Stormy@thelemmy.club 36 points 2 days ago

there should be riots in the street rn though.

[-] queermunist@lemmy.ml 2 points 1 day ago

They're waiting for the elections to fix everything.

When that doesn't work...?

Like the riots when an insurrectionist was allowed to run for a second term after being ruled ineligible by a State?

[-] obvs@lemmy.world 11 points 2 days ago

But the Roberts Court, dontchaknow, intervened and went directly against the Constitution and made a BLATANTLY unconstitutional ruling that should have invalidated literally all of their appointments.

Trump was ineligible for the second term, whether or not the Roberts Court wanted to acknowledge it.

And hell will freeze over before I give those judges on the Roberts Court the dignity of referring to them with the words that other people call them or that court.

[-] Master@sh.itjust.works 4 points 1 day ago

Its not the general votes that matter. Its the electoral college. So even if they cheated he was still elected twice.

[-] AbouBenAdhem@lemmy.world 4 points 2 days ago

The election the Constitution is referring to is the Electoral College, not the general election.

[-] UltraGiGaGigantic@lemmy.ml 1 points 1 day ago* (last edited 1 day ago)

Sounds like the foundation of our Democracy was built on quick sand, and the cement poured by the shadiest cheapest contractor capitalism could buy.

Unless somebody stops him, he'll do it. All the people that are supposed to check or balance his power are his minions.

[-] Brkdncr@lemmy.world 29 points 2 days ago

There is wiggle room in some amendments but this one seems pretty fucking clear.

[-] frongt@lemmy.zip 27 points 2 days ago

It does specify that he has to be a person. Perhaps they're going to argue he isn't?

[-] krashmo@lemmy.world 7 points 2 days ago

In a wild turn of events, he's gonna change his name to Deborah and run as our first trans President, claiming the transition resulted in him being a different person.

But then Elon Musk will crack the sads, and have a big sook, with multiple posts on Twitter.

[-] benderbeerman@lemmy.world 14 points 1 day ago

No person shall be elected to the office of the President more than twice

This is why is fun to own a whole ass supreme court:

No person shall be elected to the office of the President more than twice

Words are fun for this guy

Trump appointed president for his 3rd term

[-] gwl@lemmy.blahaj.zone 2 points 1 day ago

No person

Ah that'll be where he's trying to get in again then I assume, cause he's not a person, he's a monster

[-] stylusmobilus@aussie.zone 4 points 1 day ago

So who is going to stop it?

Trump will run again and probably win, perhaps fairly.

[-] CmdrShepard49@sh.itjust.works 12 points 1 day ago

Im sure he could make a convincing argument that he isnt a person and therefore should be allowed to sit for a third term.

[-] ShellMonkey@piefed.socdojo.com 15 points 2 days ago

The one weasel notion that I wonder about, what if he was elected VP and the president stepped down directly after? Then he wasn't elected a 3rd time but placed by successions. It wouldn't surprise me to see them try some such fuckary.

[-] wittymcusername@lemmy.zip 24 points 2 days ago

I don’t remember the exact wording, but basically to be eligible to be VP one must meet the eligibility requirements for being President. So he’s not eligible to be VP either.

But I recall someone claiming that no such eligibility requirement exists for Speaker of the House, who is in the succession line after the VP.

[-] baronvonj@piefed.social 9 points 2 days ago* (last edited 2 days ago)

the legal ~~hippthesis~~ hypothesis is for the house to vote him in as speaker of the house and then the figurehead president and VP resign.

[-] grue@lemmy.world 2 points 1 day ago

If I were a fascist psychopath who had the opportunity to be part of such a scheme, I would 100% promise to step down and then not.

[-] humorlessrepost@lemmy.world 1 points 1 day ago* (last edited 1 day ago)

To prevent that, he’d need to replace the secret service with loyal sycophants.

[-] Obviouslywrong@lemmy.world 4 points 2 days ago

Which could maybe work but even the more loyal bootlicker guys will prefer to be president than not.

They'd have to pause multiple times a day while he had his nap.

That's why ne said he's going to run. He thinks he's smart.

[-] Sumocat@lemmy.world 10 points 2 days ago

Yes, and none of that prohibits him from running for office again. The only prohibition is that he cannot be elected a third time. But here’s the thing: we don’t actually vote for President; we vote for who our Electors elect as President, and they are Constitutionally prohibited from electing Trump to a third term. If Trump runs and “wins”, the Electors cannot elect him. He can win 0 Electoral votes. Doesn’t matter what their States’ laws require because the Constitution is the highest law in the land… until SCOTUS rules the 22nd Amendment violates the 10th Amendment. 🤷🏻‍♂️

[-] gwl@lemmy.blahaj.zone 1 points 1 day ago

You forget that he stacked the deck

[-] stickyprimer@lemmy.world 6 points 1 day ago

Therefore, by his own logic, he shouldn’t be in office right now, because he won in 2020, riiiight?

[-] GuyFawkesV@lemmy.world 7 points 2 days ago

It doesn’t matter what it says when neither courts nor law enforcement will enforce it. Looks like we’re running out of democracy boxes.

[-] boatswain@infosec.pub 8 points 2 days ago

So it sounds like there's no prohibition against running, just against winning? Sounds like an easy win for the Dems.

[-] TheDemonBuer@lemmy.world 15 points 2 days ago

It seems pointless to run in an election you are constitutionally barred from winning. But, Trump has proven time and time again he will do pointless things. If he tried running again and somehow he won, however, the constitution is clear: it's a no go. He can't get elected for a third time. That said, I don't think that's necessarily the point. I think the point is to create chaos and crisis. Hopefully he's not around to run in 2028 so it becomes a moot.

[-] Obviouslywrong@lemmy.world 3 points 2 days ago

Presidential candidate gets extra protections from prosecution and can raise pac money for bribes.

[-] bertlewirth@lemy.lol 6 points 2 days ago

yes, but is anyone gonna stop him?

[-] neidu4@piefed.social 3 points 2 days ago* (last edited 1 day ago)

Well, he can run again. It's just moot, as he can't be elected. If he were to get the most electoral votes, I guess the runner up is elected?

[-] DarkCloud@lemmy.world 3 points 2 days ago

There's wiggle room, he's claiming a right to campaign. To run... He's not saying anything about being elected.

He doesn't actually do the electing. That's up to public, and the officials who are in charge of elections (who he'll try to stack with loyalists). He can't say what they'll do.

He runs, and if others elect him... Well... That's the wiggle room.

[-] PapaStevesy@lemmy.world 4 points 2 days ago

That's not wiggle room, it's violating the Constitution. Not saying it can't happen, but it's not like that's a logic loophole, it's just not caring about acting illegally.
