Attorneys say the child waived her rights by agreeing to Roblox’s “Terms of Service” at least 28 times.

I am from Kentucky and just saw this, thought it would be worth sharing on Lemmy. Feel free to crosspost wherever you see fit, it would be nice to at least spread awareness for the situation.

It should be impossible to waive your rights via TOS agreements for anyone.

8 yr old cannot legally enter into a contract.

iirc her mother also made an account signing that right away for setting up parental controls, so there a bit more to unpack here

Those terms of service have been repeatedly been found completely unenforceable in court.

They'll pass a law to change that and then enact child marriages once more. I don't know off the top of my head but that might be the case in Kentucky already.

All that the defence needs to say.

Of course they will try that tack, the question is will the judge go along with it. Needless to say an 8 year old cannot waive their rights, it would make nonsense of consent law.

Focusing on the 8 year old is disingenuous. The news reports do that because it gets more clicks. But in this case, the mother also made an account for herself, also agreed to all their terms, set her account up as a parent account for her child’s account, and then explicitly disabled the safeguards like the child not being able to chat. What the 8 year old did doesn’t matter.

I really want the family to win in this case but my fear is that if they were to that it would only push age verification laws further.

Unfortunately if the family doesn't win then there will just be more kids killings themselves than could be prevented until people can find at least some kind of solution to the Roblox issue.
